All users shall be deemed to have read and accepted the Distance Sales Agreement at the moment they complete their membership registration procedures.
Parties
This Agreement has been concluded between Goldcar Elektronik (“SELLER”) and the customer (“BUYER”) making purchases through www.goldcar.com.tr (“SITE”) under the following terms and conditions.
Subject
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale, delivery, right of withdrawal, return, and warranty conditions of the products/services ordered electronically by the BUYER through the SITE.
General Provisions
- The BUYER acknowledges and accepts that they have read the essential characteristics, sales price, payment and delivery information, right of withdrawal, and return conditions of the products/services listed on the SITE.
- The product/service shall be delivered to the address specified by the BUYER in the order form through the SELLER’s contracted shipping company.
- The SELLER may postpone delivery by informing the BUYER in cases of force majeure or extraordinary circumstances preventing transportation.
- For out-of-stock products, the SELLER reserves the right to cancel the order or suggest an equivalent product.
Delivery
- The ordered product shall be delivered within a maximum of 30 days from the date the order reaches the SELLER.
- Delivery times may vary depending on the BUYER’s address.
- If the BUYER is not present at the delivery address or refuses to accept the delivery, any additional costs arising therefrom shall be borne by the BUYER.
Right of Withdrawal
- The BUYER may exercise the right of withdrawal within 14 days from the delivery date without providing any reason.
- Notifications regarding the right of withdrawal must be submitted to the SELLER in writing or through a permanent data storage method (email, web form, etc.).
- The returned product must be sent unused, complete with its original packaging and invoice.
- Return shipping costs under the right of withdrawal shall be borne by the SELLER.
Products Excluded from the Right of Withdrawal
- Products specially prepared in line with the BUYER’s requests
- Perishable products or products with an expiration date
- Hygienic products whose packaging has been opened after delivery (headphones, underwear, cosmetics, etc.)
- Services instantly performed electronically and digital content
- Periodicals such as newspapers and magazines
- Accommodation, transportation, car rental, and similar services provided on specific dates
Warranty Conditions
- If the sold product is defective, the BUYER may exercise the optional rights granted by law (refund, free repair, replacement with a non-defective product, or price reduction).
- Warranty period and conditions are specified in the warranty certificate sent with the product.
- If damage is detected during delivery, the BUYER must request a report from the courier and refuse acceptance of the product.
- Failures resulting from improper use are outside the scope of the warranty.
Return Conditions
- Return requests may be made by the BUYER within the withdrawal period or in the event of defective goods.
- The returned product must be sent unused and together with all accessories, invoice, and any promotional/gift items.
- Once the return process is approved, the payment shall be refunded within 14 days using the same payment method used by the BUYER.
- Except for legal return rights, return shipping costs for campaign-based or satisfaction-based returns may be borne by the BUYER.
Dispute Resolution
In disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts located in the BUYER’s place of residence or where the agreement is performed shall have jurisdiction within the monetary limits determined by the Ministry of Trade.
Effectiveness
When the BUYER completes the payment approval for an order placed through the SITE, the BUYER shall be deemed to have accepted all terms and conditions of this Agreement.
