All users are deemed to have read and approved this Sales Agreement from the moment they complete their membership registration processes.

This Agreement is entered into and established between Goldcar Elektronik ("SELLER") and the individual or legal entity purchasing products/services through www.goldcar.com.tr ("SITE"), referred to as the "BUYER", under the terms and conditions set forth below.

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale, delivery, right of withdrawal, return, and warranty conditions of the products/services ordered by the BUYER electronically via the SITE.

• The BUYER has read and accepted the essential characteristics, sales price, payment and delivery information, right of withdrawal, and return conditions of the products/services listed on the SITE.

• The product/service will be delivered to the address specified by the BUYER in the order form through the SELLER's contracted courier company.

• In the event of force majeure or extraordinary circumstances that prevent transportation, the SELLER may postpone the delivery by informing the BUYER.

• For products that are out of stock, the SELLER reserves the right to cancel the order or propose an equivalent product.

• The product subject to the order shall be delivered within a maximum of 30 days from the date the order reaches the SELLER.

• The delivery period may vary depending on the BUYER's address.

• If the BUYER is not present at the address at the time of delivery or refuses to accept the delivery, any additional expenses incurred shall belong to the BUYER.

• The BUYER may exercise their right of withdrawal within 14 days from the delivery of the goods without providing any justification.

• Notifications regarding the right of withdrawal must be made to the SELLER in writing or via a permanent data storage device (e-mail, web form, etc.).

• The product to be returned must be sent unused, completely intact with its original packaging, and alongside its invoice.

• Return shipping costs within the scope of the right of withdrawal shall be borne by the SELLER.

• Products prepared individually in line with the BUYER’s specific requests or personal needs.

• Perishable products or goods that may expire quickly.

• Hygienic products (headphones, underwear, cosmetics, etc.) whose packaging has been opened after delivery.

• Services performed instantly in electronic environment and digital content.

• Periodicals such as newspapers and magazines.

• Services provided on specific dates such as accommodation, transportation, and car rental.

Warranty Conditions

• If the sold product proves to be defective, the BUYER may exercise their legal optional rights (refund, free repair, replacement with a non-defective product, or a price reduction).

• The warranty period and terms are specified in the warranty certificate sent together with the product.

• If damage is detected upon delivery, the BUYER must have the courier officer draft a damage report (tutanak) and must not accept the product.

• Malfunctions resulting from improper use or user error are excluded from the scope of the warranty.

• Return requests can be made by the BUYER within the right of withdrawal period or in the event of defective goods.

• The product to be returned must be sent unused, complete with all its accessories, invoice, and promotional gift items (if any).

• Once the return process is approved, the amount paid will be refunded to the BUYER within 14 days using the original payment method.

• For returns made outside the scope of the statutory right of withdrawal (such as specific campaigns or general customer satisfaction returns), the return shipping costs may belong to the BUYER.

Dispute Resolution

In disputes that may arise from this agreement, Consumer Arbitration Committees (Tüketici Hakem Heyetleri) and Consumer Courts (Tüketici Mahkemeleri) at the BUYER's place of residence or where the agreement is executed shall have jurisdiction within the monetary limits determined annually by the Ministry of Trade.

Enforcement

The BUYER is deemed to have accepted all the clauses of this agreement at the moment they complete the payment confirmation for the order placed on the SITE.
